Court Issues Preliminary Injunction to Halt Default Termination of Federal Subcontractor

In a significant ruling for the federal government contracting community, a Virginia state court recently granted preliminary injunctive relief to prevent a subcontractor from being terminated for default. In its ruling, the court found that the subcontractor demonstrated that it would likely succeed on the merits that the prime contractor breached the subcontract and initiated an improper termination. The court’s order in Amentum Services, Inc. v. Valiant Government Services, Inc.,  No. CL-2025-19335 (Va. Cir. Jan. 14 2026) underscores the risks surrounding terminations for default and workforce poaching concerns. Read the article

As always, the legal and regulatory framework remains important, but the ten maxims set forth herein can provide important insight for stakeholders when trying to effectively manage risk, avoid exposure, and build a project rather than a lawsuit. While the number of protests filed with GAO in FY25 dipped modestly, underlying challenges – ranging from noncompliance with procurement standards to sustained interagency disagreements – paint a picture of strained integrity in the procurement process. Unlocking Discovery in International Arbitration: Creative Strategies After ZF Automotive

The Supreme Court’s ZF Automotive decision has thrown a wrench into the gears of international arbitration, significantly limiting access to U.S. discovery under 28 U.S.C.A. § 1782 for private commercial disputes. However, declarations of its demise may be premature. The DOT’s Disadvantaged Business Enterprise Program – Is the End Imminent?

FOR MORE THAN 40 years, the U.S. Department of Transportation (DOT) has administered its Disadvantaged Business Enterprise (DBE) contracting program, which is designed to satisfy Congress’s mandate that at least 10% of federal highway construction funds be paid to small businesses owned and controlled by “socially and economically disadvantaged” people. This DBE program, however, may soon be “dead on arrival,” as recent litigation heads to an outcome with sweeping consequences for contractors as well as sureties who do business with them. Read more
