Rick Mann focuses on construction claims and has litigated in numerous domestic and international forums. He represents contractors, sureties and owners in a wide variety of construction matters. His practice focuses on the provision of advice concerning project management and the preparation, evaluation, negotiation and litigation of claims.

Among Mr. Mann’s more important engagements are federal lawsuits pertaining to a coal gas pipeline, a $300 million tunnel in Connecticut, and precast buildings for a $12 billion LNG plant; state civil actions involving two major bridges in Georgia, dismantlement for export of an ammonia plant in Mississippi, the Miller Park baseball stadium in Milwaukee, a coal processing plant in Wyoming, and a major water tunnel in southern California; board hearings concerning default terminations of government contracts; international arbitrations involving a Saudi construction project and an embassy project in Taiwan; domestic arbitrations concerning a major court house in Las Vegas and design of a major bridge; and preparation of a claim settled for over $100 million concerning a major bridge. Additionally, he has lectured internationally and in the United States concerning a range of construction contract and dispute issues.

REPRESENTATIVE PROJECTS

Gerald Desmond Replacement Bridge (Cable-Stayed), Long Beach, California
Shimmick Construction Company, Inc./ FCC Construcción SA /Impregilo S.P.A., a Joint Venture

Provided project counsel services.  Successfully litigated action to force Port of Long Beach to nominate DRB replacement and participate in DRB process.  Developed winning legal theories for $100 million plus claim for owner interference in design and crafted DRB position paper and presentation for same. Led technical analysis for claims against designer reaching favorable settlement.

NJT Hudson-Bergen Light Rail, Newark, New Jersey
Washington Group Inc.

Represented Design-Build contractor in two suits concerning the Weehawkin Tunnel and another portion of the light rail line. Both suits successfully settled.

San Vicente Pipeline, San Diego County, California
Traylor Brothers/Shea, JV

Represented contractor in state court action concerning differing site condition. Successfully settled.

Union Station Link Structure and Parking Garage, Washington, D.C.
Kora & Williams Construction Company

Represented contractor in board action involving default termination for delay.  Defective sequencing specifications and improper administration of track outages caused majority of the delays. Board invalidated default termination and contractor and surety received over $40 million.

Guy F. Atkinson Company and Recchi America

Represented contractors in state court actions against Georgia DOT concerning defective design (construction scheme).  Successfully settled actions.

KFx Coal Processing Plant, Gillette, Wyoming
Walsh Construction Company

Represented design/build contractor against owner of failed coal processing plant.  Issues included validity of coal processing process and quality of plant process designs.  Received jury verdict of one hundred percent of claim and owner’s claim was denied entirely.

Milwaukee Brewers’ Ballpark, Milwaukee, Wisconsin
Mitsubishi Heavy Industries

Represented contractor in state court against owner alleging defective design/build of movable roof system for baseball park. Issues included allegations of defective mechanical and structural designs, mis-fabrication and defective construction, and constructive changes. Obtained favorable settlement.

Regional Justice System, Clark County, Nevada
AFC Construction Company

Represented contractor and surety in arbitration involving default termination from Las Vegas courthouse contract.  Three arbitrator panel overturned default termination and awarded over $53 million.

Sewer Outfall Capture Shaft Contract No. 2, Dearborn, Michigan
Posen Construction Inc.

Represented contractor in state court action concerning failed self-sinking caisson construction project.  Issues included appropriateness of geotechnical design and effectiveness of rock and jet grouting.  Case successfully settled through special case evaluation under Michigan court rules.

Linden GM Co-Gen Plant Upgrade, Linden, New Jersey
Agmen, Inc. / Mountbatten Surety

Represented mechanical contractor that had been terminated for default by Quixx/Utility Engineering.  Defended excess completion cost claim of $15 million.  Prevailed in “Nighttime Baseball” arbitration.

National Conservation Training Center, Shepherdstown, West Virginia
Just Wood Industries

 Represented terminated subcontractor and surety against general contractor in federal court action.  Jury awarded ninety percent recovery by subcontractor and denied recovery to general contractor.

South Hartford Conveyance and Storage Tunnel, Hartford, Connecticut
Kenny/ Obayashi JV

Represented contractor for four mile long, 18-foot diameter tunnel against Metropolitan District for damages and delays caused by differing site conditions.  Obtained successful settlement.

Repave Missile Haul Route, NSB Kings Bay, Georgia
Central Southern Construction

Represented contractor for re-pavement of high-security nuclear missile haul road on Trident submarine base concerning costs of additional work and owner delays.  After appealing contracting officer’s final decisions to the ASBCA, NAVFAC paid a ninety-nine percent recovery.
